David E. Brookstone - ASSOCIATE

David E. Brookstone brings to the firm 20 years of litigation experience, involving all phases of landlord-tenant litigation, including representing landlords in 7A proceedings, harassment proceedings, HPD civil penalty proceedings, Article 78 proceedings, and at administrative and enforcement hearings at the Division of Housing and Community Renewal (DHCR), Housing Preservation and Development (HPD), and the Environmental Control Board (ECB).

Before joining the firm, Mr. Brookstone headed his own firm for twenty years, accumulating extensive trial experience, representing residential and commercial tenants, and small, medium and large size landlords, in all phases of housing litigation at the trial and appellate level.

Mr. Brookstone was chief counsel to a large landlord who was the subject of an extensive enforcement proceeding brought by the newly formed Tenant Protection Unit (TPU) of DHCR. The Governor of New York publicly announced the TPU’s commencement of the proceeding, naming Mr. Brookstone’s client, which garnered significant publicity.  After extensive litigation defending against numerous allegations, the TPU eventually offered to Mr. Brookstone’s client a settlement of the enforcement proceeding, with very favorable terms.

Mr. Brookstone graduated from Tulane University in 1992 and from New York Law School in 1996, Cum Laude, where he received the Sylvia D. Garland Award for excellence in academic subjects relating to civil litigation.
